Lawyers to President Donald Trump, filed an appeal on Trump in New York Hush Money, argued that their appeal had to be moved to a federal court because the prosecutor relied on evidence related to his official acts as president.

Trump was sentenced to last year for 34 accusations of crime falsifying business records in the Supreme Court of the State of New York, but he tried to move his appeal to the Federal Court.

On Tuesday, Trump’s lawyer argued in submission to the US appeal court for the 2nd circuit that the prosecutor at the Manhattan District Prosecutor’s Office invited a transfer by introducing evidence about Trump’s official actions.

“An important category of Dany’s trial evidence is included in the testimony of President Trump’s oval office communication with the Attorney General and the Director of White House communication about the issues of public concern on the official side of the path,” wrote Trump’s appeal lawyer, using an acronym for the Manhattan District Prosecutor’s Office.

The submission quoted a portion of the testimony of former Trump Michael Cohen’s lawyer and testimony by former White House Communication Director Hicks about Oval office discussions with Trump during his first term of office in the office.

The prosecutor said the two witnesses were discussing what was basically a personal scheme that occurred before Trump served.

The prosecutor also argued that Trump waited too long to submit post-truth transfer, but his lawyer called it “unreasonable” because “his campaign was reversed by various shocking events, including the almost lost murder effort and the exit of President Biden from the race.”

Trump was found guilty of last May on 34 accusations of crime falsifying business records related to payment of money made for adult film actress Stormy Daniels to increase the prospect of her election in the 2016 presidential election. After the re -election of Trump, New York Judge Juan Merchan judicially punished her to exit without conditions, fines or probation – to protect “Presidential Office.”

Trump has twice tried to move the Manhattan DA case to the Federal Court, but a District Court judge denied it, deciding on the behavior in question had nothing to do with the President’s work.
