The appeal court said DOJ could not represent Trump in the appeal of the E. Jean Carroll case

American taxpayers will not pay for the ongoing appeal from the defamation case of President Donald Trump worth $ 83 million, the federal appeal court was determined on Wednesday.

The judge panel at the 2nd US Circuit appeal court on Wednesday denied Trump’s request to ask the lawyer of the Department of Justice to argue in his appeal for the defamation case of E. Jean Carroll’s columnist’s defamation against Trump.

Last year’s New York jury ordered Trump to pay for a former Elle $ 83.3 million columnist in damage because he slandered him in 2019 when he denied his accusation that he sexually attacked him in the dressing room of a Goodman Department Store Bergdorf in the mid-1990s. Trump has denied all accusations.

DOJ’s lawyer argues that because of some alleged Trump’s behavior, including in the scope of his role as president, the Department of Justice must be able to defend the president in court.

“Substitution is needed because once the Attorney General stated that the defendant acted in the scope of his office or work, the United States was the defendant of the party except and until the court decided on the contrary,” they said.

ABC News has contacted Trump’s legal team to comment.

Oral arguments in Trump’s appeal to this case are set for June 24.

Last week the 22nd circuit denied Trump’s request to train his challenge for a civil assessment of $ 5 million other judges given by Carroll in 2023.
