The 2nd judge ruled the use of Trump on alien enemies for deportation to violate the law

A federal judge in New York decided on Tuesday that the alien enemy law “was not legally called” by the Trump government when he chose to deport members of the de Aragua trend, marking the second time a judge considered the use of AEA that violated the law.

The US District Judge Alvin Hellertein on Tuesday granted the preliminary order in the case of two plaintiffs identified by their initials, GFF and JGO, who were withdrawn from the plane to El Salvador and were moved back to New York from Texas, where they were detained because of the alleged explanation with Venezuelan De Aagua.

Tuesday’s decision came after a federal judge appointed by Trump in Texas last week blocked the Trump government permanently from holding, transferring or removing the targeted Venezuela for deportation under the Alien enemy law in the South Texas District-decided that administrative prayers for the AEA “exceeded the scope of” the law.

Trump’s government has requested the 18th century war enemy alien enemy law used to remove non-citizens with a non-existent process to deport migrant gang members by arguing that the de Aragua trend is a “hybrid criminal state” that attacks the United States.

The US Supreme Court, in the decision 5-4 months ago, raised orders issued by Federal Judges in Washington, DC, who had stopped deportation under the aea-but said prisoners had to be given a legal process to challenge their transfer in the district where they were detained.

GFF and JGO “have not been given a notification about what they do to join TDA, when joining, and what they do in the United States, or anywhere, to share or further the illegal goals of TDA,” said Hellertein Hakim. “Without such evidence, petition makers can be removed by executive orders, which are contrary to the AEA and constitutional requirements of the legal process.”

Hellertein also said Trump was not justified when he asked for an alien enemy law.

“I argue that the predicate for the President’s proclamation that TDA has been involved in ‘war,’ invasion ‘or’ predator attack ‘from the United States,” Hellertein said. “There is nothing in AEA that justifies the findings that refugees who migrate from Venezuela, or TDA gangster who infiltrate migrants, are involved in ‘invasion’ or ‘Predator Court orders.'”

Judge Hellertein held a trial in this matter for May 21.
